Terms and Conditions Monthly Programs

The Client wishes to purchase either a monthly job posting program or a monthly job slot program from Urban Indoor Media Ltd. hereinafter called NetHire under the following terms and conditions.

NetHire will distribute and post the Client’s job posting(s) onto 3rd party job boards, social media channels and search engines and invite people to review. Once posted, the job posting(s) can be turned off however cannot be fully removed from 3rd party job boards, search engines or social media due to the viral nature of the internet.

Monthly posting programs are billed and charged for monthly. The monthly period can be from 28 to 31 days depending on the month and is called a Monthly Posting Period, hereinafter called an 'MPP'.

This is an ongoing monthly program into perpetuity until either the Client or NetHire gives notice of cancellation with a minimum (3) full MPPs - being approximately 90-93 days. Once a cancelation notice is given, the Client will receive a confirmation, and the Client will only be responsible for 3 more MPP invoices and payments, and the Client’s account will remain active for the last 3 MPPs.

Candidate Management System (CMS)

Our online CMS is included to save you time and hire better including unlimited users including recruiters and hiring managers; unlimited applicants; AI Candidate Recommender; documents and storage; qualifying questions; video questionnaires; applicant self-scheduled interviews; calendar integrations with Microsoft, Google and Zoom; templated offer letters and employment agreements. The Client's job posting(s) will be posted through the NetHire CMS.

Applicants can be seen and managed in the NetHire CMS, be forwarded to a Client’s email or applicants can be forwarded to the Client’s career page or online job posting.

Communication Hub

Includes email messaging, SMS texting and calling with recordings. Also includes templated emails and SMS texts. Included per account is 1 local phone number, 250 SMS text messages and 250 phone minutes per account per MPP. Additional phone numbers are $29 per MPP each, additional texts are $29 per 250 and additional phone minutes are $29 per 250 minutes per MPP. Usage is per MPP and no rollover of texts and calls.

No Liability

The Client agrees that NetHire cannot be held liable for any loss, however caused,including but not limited to technical issues, loss of data, viruses, job posting inaccuracies, job postinglocations, loss of applicant resumes or contact information, employee loss or for any other reason. TheClient accepts use of the job postings and AMS system on an 'as is basis'. The Client agrees to defend,indemnify, and hold harmless Urban Indoor Media Ltd, NetHire, its officers, directors, employees andagents, from and against any claims, actions or demands, including without limitation reasonable legal andaccounting fees, alleging, or resulting from the use of the NetHire system. NetHire’s only liability is toextend the job posting and the use of the CMS for any days the posting or the CMS was down due totechnical issues.

Monthly Job Posting Programs

The Monthly Fee is for a MPP being 28-31 days depending on the month.

Each monthly job posting is a 30-day posting. Each posting is good to use for 90-days from it being added to your account. Additional job postings in a MPP will be charged at an additional job posting cost equal to the pro rata cost of each posting in the current program. An example would be a $1,200 per month program for 2 monthly job postings. Therefore, the pro rata cost of each posting is $600. All additional postings will therefore be $600 each.

The oldest job posting credit will be used first when posting jobs.

Monthly Job Slot Programs

Job Slots are single job postings that can be changed as required. The payment is for a job slot for a 30-day MPP. Each job slot shows only 1 job at a time, but the job showing can be changed at any time up to a maximum 4 times per month. Additional jobs posted above 4 in any slot will be charged for at the rate of $149.

Job Posting Content

Only bonified employment opportunities may be posted onto the NetHire network. No job posting may ask the applicant to pay money to find a job. NetHire may alter or remove postings that are not bonified job opportunities, ask for money or contravene the then current NetHire job posting rules or any laws of the country or province/state. The Client permits NetHire to change or modify job postings and titles to assist in attracting candidates to the job posting.

Cancellation is 3 MPPs - being 91-93 days

Once the credit card has been processed, there are no refunds for any reason. Cancellation or the downsizing of the program requires 3 MPPs - being 91-93 days. There is no guarantee as to applicant quantity or quality. Cancelations can not be done by telephone. Cancelations must be by email to accounting@nethire.com, sales@nethire.com and the Client’s Account Manager’s email. You will be emailed a notice within 24 hours confirming the cancelation. No cancellation is permitted by a phone call with anyone including with your Account Manager. It MUST be done via email as noted in this paragraph. You must receive a confirmation of cancellation by email.

Payment Terms

The credit card on file will be charged upon acceptance of these terms for the first MPP. The credit card will then be charged every month on the same day of month for each MPP thereafter as well as any additional charges. The Client agrees to pay the credit card issuer the monies charged. Job posting credits may be used as soon as the credit card is authorized. When a Client’s credit card will not process for any reason, the CLIENT MUST provide a new credit card that will process within 3 business days. If a Client fails to provide a new credit card that will process after 3 requests combined by email and calling, the Client shall pay $5,000 penalty for non-production of a valid credit card, the program will cease and all payments including 3 additional MPP payments shall become due immediately. If any monies become owning to NetHire and payment is not received in full within 15 days of a demand, interest accrues at 3% per month until paid. The Client becomes responsible for all legal and court costs of NetHire should collections or court action be required to collect any outstanding monies including pre and post judgement interest and court costs as the court may award. A Client fraudulently canceling an already processed payment by cancelling the credit card or claiming it was stolen shall pay to NetHire all the fees outstanding plus a $5,000 penalty for each payment cancelled or not honoured by the credit card processor or bank. Every year on the annual anniversary date of the original purchase, the MPP fees will be raised by 3.95%.

Currency

Canadian Job Postings are charged in Canadian dollars. US job postings are charged in US dollars.

NO AGREEMENT, VERBAL OR OTHERWISE NOT EXPRESSED IN THESE TERMS IS TO BE CONSIDERED PART OF THIS CONTRACT.

This is an Ontario Canada contract and will be adjudicated by a court of competent jurisdiction in the Region of Peel, Ontario Canada. NetHire is an operating company of Urban Indoor Media Ltd.

I have permission to bind the company and understand I am entering into an agreement for a monthly program that can not be cancelled until I/we give 3 full MPPs notice - being roughly 91-93 days notice.
