Job Posting Terms and Conditions

The Client wishes to purchase job posting credits from Urban Indoor Media Ltd. O/A NetHire hereinafter called NH for the distribution of a Clients’ job posting(s) thru the NetHire Network of job boards under the following terms and conditions and understands NH will post the Clients’ job posting(s) onto 3rd party job boards, social media websites and search engines. Once posted, the job posting(s) can be turned off however cannot be fully removed from 3rd party job boards, search engines or social media due to the viral nature of the internet.

Job Posting Content – Only bonified employment opportunities may be posted onto and thru NH. No job posting may ask the applicant to pay money to find a job. NH may alter or remove postings that are not bonified job opportunities, ask for money or contravene the then current NH job posting rules. The Client permits NH to change or modify job postings and titles to assist in attracting candidates to the job posting.

Job Postings are divided into job description, company profile, logo and contact information. The Client will place information in its appropriate place. Should the Client place information in the wrong area, NH reserves the right to change, move and modify the information so as to meet the then current job posting rules. Should a Client continue to not follow the then current job posting rules, NH may without refund turn the job posting off and/or limit system access to the Client. No phone numbers or emails are permitted in job postings.

Candidate Management System (CMS) - NH provides a CMS to the Client. All content of the system including candidate resumes are the sole property of NH. The Client is given non-exclusive access to candidates’ resumes during the period of the agreement and up to 90 days after the agreement has ended or 90 days after the last job posting has expired. Accounts will be considered inactive and abandoned where no activity has taken place in 24 months. At this time all data including resumes, notes and candidate information within the Clients’ account may be deleted.

No Liability - The Client agrees that NH cannot be held liable for any loss, however caused, including but not limited to technical issues, loss of data, viruses, job posting inaccuracies, job posting locations, loss of applicant resumes or contact information, employee loss or for any other reason. The NH system is provided “as is” without warranty. The Client agrees to defend, indemnify, and hold harmless NH, its officers, directors, employees, and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging, or resulting from the use of the NH system. NH’s only liability is to extend the job posting for any days the posting was down due to technical issues.

No Refunds – Once the credit card has been processed a purchase has been made, there are no refunds for any reason. Refunds are never provided for any reason.

Applicant Quantity and Quality – NH is not responsible in any way for the quality or quantity of applicants. The quantity and quality of candidates you may or may not receive is based on many factors including but not limited to: the pay you are offering, location, Clients’ reputation among many other reasons.

Job Posting Credits Term – Job Posting credits purchased online here are good to use for two (2) years from purchase date. Unused credits expire on the close of business 730 days after purchase date. Credits can be reactivated for another 12-month term within 180-days of the credits expiring at $89 per job posting credit.

Guaranteed Job Postings – If you have purchased a Guaranteed Job Posting, you are guaranteed to make a hire or receive a minimum 25 in-country applicants in the first 28-day posting period. If you do not make a hire or receive a minimum 25 in-country applicants, we will rerun the posting for up to an additional 2, 28-day periods totaling 84 days. At the end of each 28-day period, if the guarantee has been satisfied, the job posting will end. There is no guarantee on the quality of applicants, only the total being 25 in-country applicants. The Guarantee is 10 applicants for Owner/Operator, Commission Only, Contractor or Self-Employed jobs and/or opportunities.

Right to Change – NH works to best optimize each job posting to receive the maximum number of qualified applicants. The Client gives NH permission to change titles and text of job postings to maximize response. NH can not be held liable in any way for changes or alterations made to a job posting.

Terms – The Client agrees to pay the credit card issuer the monies charged. Job posting credits may be used as soon as the credit card is authorized and placed into the Client’s account. No cancellations or refunds for any reason. If any monies become owning to NH, interest accrues at 3% per month until paid. Client is responsible for all legal and court costs of NH should collections or court action be required to collect any outstanding monies.

Currency – Canadian Job Postings are charged in Canadian dollars. US job postings are charged in US dollars

NO AGREEMENT, VERBAL OR OTHERWISE NOT EXPRESSED IN THESE TERMS THAT YOU THE CLIENT ACCEPT WHEN YOU CLICK TO PURCHASE IS TO BE CONSIDERED PART OF THIS CONTRACT.

This is an Ontario Canada contract and will be adjudicated by a court of competent jurisdiction in the Region of Peel, Ontario Canada.
